                                ORDINANCE NO. 9819
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 8867, AS
                   AMENDED, ENCAPTIONED AS SET FORTH HEREIN, SO AS
                   TO AMEND CERTAIN CONDITIONS, RELATIVE TO
                   CLOSURE.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 8867,
         encaptioned "AN ORDINANCE CLOSING AND ABANDONING A PORTION OF
         APPLEGATE LANE LOCATED NORTHWEST OF GUNBARREL ROAD NORTHEAST OF 

         EAST BRAINERD ROAD, MORE PARTICULARLY DESCRIBED HEREIN, AND AS
         SHOWN ON PLAT ATTACHED HERETO AND MADE A PART HEREOF BY
         REFERENCE, UPON CERTAIN CONDITIONS." be and the same is hereby
         amended as follows:
                                        
                   1.	That Condition 1 be amended by
                   substituting  the following new language:
                  
                   	(1)  The City of Chattanooga 16'
                        sewer easement as shown on Plat Book
                        42, Page 324 shall be retained.  The
                        15'sewer as platted, with an implied
                        easement, shall  be abandoned, as
                        shown on the attached  map. (Exhibit
                        1); and
                  
                   2.	Conditions 2, 4, 5 and 6 are to be
                   amended by deleting them in their entirety.

                   3.	Condition 3 is to be amended by
                   substituting the following new language as
                   Condition 2:
                  
                   	2.  The Tennessee-American Water
                   Company reserves its easement as shown on
                   the attached map. (Exhibit 3)
                  
                  
        
         	   BE IT FURTHER ORDAINED, that this Ordinance shall take
         effect two weeks from and after its passage,  the public 
welfare
         requiring it.
